答覆 | 勞動部勞動力發展署 Workforce Development Agency, Ministry of Labor 外國學生來臺實習,依勞動部82年9月3日(82)臺勞職業字第48656號函釋略以,應本國際平等互惠原則及國際學術交流目的,且不涉及勞務之提供,其支給之獎金如非勞務之報酬,則無違反就業服務法;另參照教育部103年1月22日臺教高(四)字第1020140814B號令釋,外國學生來臺就學因課程學習或服務學習需要,非屬工作之範疇,亦即無需申請工作許可。綜之,實習係學員與企業單位之管理人既不具僱傭關係,亦未有訓練實習活動以外之勞務提供或工作事實,故無就業服務法之適用。 According to the letter No. (82)-Tai-Lao-Chi-Yeh-Tzu-48656 issued by the Ministry of Labor dated September 3, 1993, which is summarized that foreign students, who come to Taiwan for internship, shall be based on the principle of international equality and reciprocity and for the purpose of international academic exchanges, without involving the provision of labor services. If the bonus paid is not the remuneration for the labor service, there is no violation of the Employment Service Act. In addition, according to the decree No. Tai-Chiao-Kao-(4)-1020140814B issued by the Ministry of Education dated January 22, 2014, which explains that foreign students who come to Taiwan to study and are in need of courses for learning or service learning, shall not fall within the scope of work, that is, there is no need to apply for a work permit. In summary, the internship between the student and the manager of enterprise does not constitute the employment relationship, nor do students provide labor services or have the facts of working other than training and internship activities, therefore, there is no application of the Employment Service Act. 教育部 Ministry of Education 一、依本部103年1月22日臺教高(四)字第10201408148B號令,專職或兼職工作指具有勞務之提供或工作之事實,不論有償無償皆屬之,但不包括下列課程學習及服務學習。所稱「課程學習」: 1. According to the decree No. Tai-Chiao-Kao-(4)-1020140814B issued by the Ministry of Education dated January 22, 2014, full-time or part-time work shall refer to the labor service being provided or the fact of working, whether paid or unpaid; however, the following courses for learning and service learning are excluded. The so-called “learning through courses”: (一)指為課程、論文研究之一部分,或為畢業之條件。 (1) Shall refer to one part of the course or research thesis, or a condition for graduation. (二)前項課程、論文研究之一部分或畢業條件,係學校依大學法、專科學校法授權自主規範,包括實習課程、田野調查課程、實驗研究或其他學習活動。 (2) The aforementioned one part of the course or research thesis, or a condition for graduation is under autonomous regulations of the school authorized in accordance with the University Act and Junior College Act, including internship courses, field survey courses, experimental research, or other learning activities. (三)該課程、論文研究或畢業條件應一體適用於本國學生、外國學生、僑生、港澳生或大陸地區學生。 (3) Such course, research thesis, or condition for graduation shall uniformly apply to domestic students, foreign students, overseas Chinese students, students from Hong Kong and Macao, or students of the Mainland China area. (四)符合前三目條件,未有課程學習活動以外之勞務提供或工作事實者。 (4) Shall meet the requirements of the preceding three items without involving the provision of labor services or the fact of working other than learning activities through courses. 二、各大專校院校外實習課程係學校依大學法、專科學校法授權自主規範,爰由學校依據前開令釋,釐明及認定「校外實習」課程是否確屬「課程學習」之範疇。經學校確認該校外實習如屬「課程學習」之範疇者,按勞動部(改制前行政院勞工委員會)102年9月2日勞職管字第1020074118號函釋之意旨,得無需申請工作許可證(亦即不受每周20小時之限制),依學校訂定之校外實習相關規範、學校與實習機構所簽訂之實習契約等辦理。如不屬「課程學習」範疇者,須依勞動部就業服務法及其相關法規辦理。 2. The off-campus internship course of various colleges and universities shall be under autonomous regulations of the school authorized in accordance with the University Act and the Junior College Act. Therefore, it shall be for the school to clarify and identify whether the “off-campus internship” course indeed falls within the scope of the “learning through courses” in accordance with the aforementioned decree. If it is confirmed by the school that the off-campus internship falls within the scope of the “leaning through courses”, according to the purport of the letter No. Lao-Chih-Kuan-1020074118 issued by the Ministry of Labor (formerly known as the Labor Committee of the Executive Yuan before the restructuring) dated on September 2, 2013, it may not be required to apply for the work permit (that is, not being subject to the limit of 20 hours per week) but shall be handled in accordance with the relevant rules of the off-campus internship formulated by the school, and the internship contract signed between the school and the internship institution, etc. If it does not fall within the scope of the “leaning through courses”, it shall be handled in accordance with the Employment Service Act of the Ministry of Labor and related regulations. |
