學生至校外企業實習並領取實習津貼,企業是否須幫學生保勞健保?Does a company need to provide labor and health insurance for an intern student who is offered internship stipend by the company?

依全民健康保險法第9條、第10條、第11條、第15條及同法施行細則第8條、第20條、第24條第3項規定,僑(外)生在臺就學期間,符合參加健保資格,應以健保第6類第2目被保險人身分投保,並以學校為投保單位。僑(外)生經許可在臺工作,經事業單位僱用,每個工作日到工,或每週工作時數滿12小時(含12小時)以上,應由雇主為其辦理以第1類被保險人身分投保健保,同時應於學校辦理健保退保轉出,惟僑(外)生若原有之投保資格尚未喪失,其從事短期性工作未逾3個月者,得以原投保資格繼續投保。至勞保相關問題,請向勞動部勞工保險局洽詢。
According to Article 9, Article 10, Article 11 and Article 15 of the National Health Insurance Act, and Article 8, Article 20 and Paragraph 2 of Article 24 of the Enforcement Rules of the National Health Insurance Act, overseas Chinese and international students studying in Taiwan who are qualified to enroll in health insurance during the period of their studies should be insured under Health Insurance Item 2 of Category 6, and their university should be the insuring unit. Overseas Chinese and international students who are permitted to work in Taiwan and are employed by a business unit for work on every working day or for 12 or more hours of work per week should be enrolled in health insurance by the employer under Category 1. At the same time, the health insurance should be transferred out from the school. However, if the overseas Chinese and international students have not lost their original insurance status and are engaged in short-term work of less than 3 months, they may retain their insurance status with their original insurer.
