外國專業人才延攬及僱用法重點規定：

用詞定義：Terminology

一、外國專業人才：指得在我國從事專業工作之外國人。
1. "Foreign professional" means a foreign national who engages in professional work in the State.

二、外國特定專業人才：指外國專業人才具有中央目的事業主管機關公告之我國所需科技、經濟、教育、文化藝術、體育、金融、法律、建築設計、國防及其他領域之特殊專長，或經主管機關會商相關中央目的事業主管機關認定具有特殊專長者。
2. "Foreign special professional" means a foreign professional who possesses special expertise needed by the State in science & technology, the economy, education, culture & the arts, sports, finance, law, architectural design, national defense, and other fields, as announced by the central competent authority of the industry concerned, or who has been recognized by the Competent Authority in consultation with the central competent authority of the industry concerned as possessing special expertise.

三、外國高級專業人才：指入出國及移民法所定為我國所需之高級專業人才。
3. "Foreign senior professional" means a senior professional needed by the State as prescribed in the Immigration Act.

一、外國專業人才經許可在臺得從事短期補習班技藝培訓教師工作、自由藝術工作。

1.短期補習班聘僱外國專業人才從事具專門知識或技術教師工作  Short-term tutorial school teacher with specialized knowledge or skills
具專門知識或技術，且經中央目的事業主管機關會商教育部指定之短期補習班教師。
Foreign professional possessing specialized knowledge or skills, and approved as a short-term tutorial school teacher by the central competent authority of the industry concerned in consultation with the Ministry of Education.

2.外國自由藝術工作者  Foreign professional artist
外國專業人才為藝術工作者，得不經雇主申請，逕向勞動部申請許可。
A foreign professional who works as an artist may, without applying through an employer, apply direct to the Ministry of Labor for a permit to engage in artistic work in the State. 
 

二、外國特定專業人才聘僱許可申請最長5年 The permission to employ a foreign special professional to engage in professional work shall be for a term of up to five years.

一般外國專業人士，並具有我國政府公告各領域之特殊專長，可申請認定為外國特定專業人才以取得就業金卡，或最長5年的聘僱許可。
應符合外國人從事就業服務法第46條第1項第1款至第6款規定之各工作類別的工作內容。

三、取得永久居留外國專業人才的成年子女，經內政部移民署認定在臺居留達一定期間以上，得申請工作許可。Where a foreign professional who engages in professional work in the State, a foreign special professional, or a foreign senior professional has been approved for permanent residency, their child who is over the age of majority may apply direct to the Ministry of Labor for a work permit to engage in work in the State, and need not apply through an employer.

外國專業人才成年子女，經向勞動部申請取得工作許可後，從事工作類別無限制。
所從事的工作，若依其他法規，應先取得專業資格證明或執業登記始得從事(如醫師)，則外國專業人才成年子女，應依其他法規取得相關資格。

 

四、學校教師工作(學校教師自107年2月8日起改向教育部申請) School teacher

From 2018 February 8, work permit application for school teacher shall be submitted to and issued by the Ministry of Education.
