答覆 | 1. 查勞動基準法第 21 條第 1 項規定:「工資由勞雇雙方議定之。但不得低於基本工資。」行基本工資為每月新臺幣(以下同) 23,800元;每小時 158 元 ;前者係指勞雇雙方約定按「月」計酬,且依法定正常工作時數上限(每週 40 小時)履行勞務之最低報酬,後者則係勞雇雙方約定按「時」計酬者單位時間之最低報酬。 According to Paragraph 1, Article 21 of the Labor Standards Act: “A worker shall be paid wages as determined through negotiations with the employer, provided, however, that such wages shall not fall below the basic wage.” Currently, the basic wage is NT$23,800 per month; NT$158 per hour. The former refers to both the employer and employee agreeing upon the minimum payment on a “monthly” basis to perform labor services in accordance with the maximum legal normal working hours (40 hours per week); while the latter refers to the minimum remuneration agreed upon by both the employer and the employee on a “hourly” basis. 2. 凡受僱於適用本法之事業單位之按時計酬勞工(含所謂工讀生)於法定正常工作時間內每小時工資均不得低於 158 元。雇主如有違反規定之情事,勞工可向工作所在地勞工行政主管機關申訴,以維權益。 The labor (including the so-called part-time student worker), paid on an hourly basis and employed by undertakings to which this Act applies, shall not be paid less than NT$158 per hour within the legal normal working hours. If the employer violates such regulations, the labor may file the complaint with the local labor authority where the place of work is located, to protect his/her rights and interests. |
